PRIVACY POLICY

Legatech Solutions LLP, having its office at Blue Ridge Township, T10-303, Hinjewadi Phase 1, Pune -411057, India and/or its associates, related parties, successors, and assigns (collectively here in after referred to as “Provider”, “us”, “we” or “our”) operate the website MultiCounsel (the "Website") and the application(s) named ‘LegaConnex’ & ‘MultiProjex’ (the “App”). The Website and App, along with all associated software, design, servers, data, user inputs and associated services shall collectively be known as the “Platform”. The services we provide to you via the Platform shall be known as the “Services”.

 

Provider has created this document (here in after referred as “Privacy Policy”) to demonstrate our firm commitment to User’s and your (collectively here in after referred to as “User”, “you” and “your”) privacy. The provisions set out in this Privacy Policy prescribe our policies regarding the use, processing and dissemination of personal information submitted by you to us when you use our Platform whether through or in connection with the Services.

 

1.       ACCEPTANCE OF POLICY

1.1.    This Privacy Policy is supplementary to the General Terms and Conditions (“T&C”) and is incorporated into the T&C by this reference. Unless otherwise defined herein, all capitalized terms are defined in the T&C.

1.2.    By providing Provider with User’s personal information in any way, User agrees to be bound by this Privacy Policy.

1.3.    If Users are accessing or using the Platform, please be aware that the Platform may contain links to websites of third parties. By clicking on such links, User may be transferred to the website of the third party. The Provider is not responsible in any way for the privacy practices of such third parties and the Users are advised to view and read the privacy statements issued by the third parties to ensure that the User understand and agree to the same.

 

2.       COLLECTION OF DATA

2.1.    User’s privacy and security is of utmost importance to the Provider. The provider will always follow the principles of this Privacy Policy and ask the User how the User would like the Provider to communicate with the User.

 

2.2.    User may be required to provide certain information, including any information which may be used to personally identify the User (“Personal Information”), in the applicable contact form as part of User’s Registration Data. Personal Information includes User’s name, company name, address, phone number(s) and email address and any other information which may, or may lead to, the disclosure of the User’s identity as an individual.

 

2.3.    User may be required for availing our Services to make payments. When you are making any payments, we collect billing details from you such as your name, name of company, billing address, contact number, payment method and IP address, and then redirect you to a secure payment service provider platform operated by our payments partner(s) Razorpay, Paytm etc and other payment partners which may be added time to time. We do not store any payment related information such as credit/debit card details and/or bank details.

 

2.4.    We also collect data on the pages of our Services that you visit, the time and date of your visit, the time spent on those pages, default language and user preferences, and other similar usage related statistics. We may assign each User of the Services unique identifiers to help keep track of future visits. With the help of third parties like Google and Facebook, we collect information that your browser or mobile device sends to them whenever you visit our Services ("Log Data"). This Log Data includes information such as your computer’s Internet Protocol ("IP") address, geolocation and geospatial data, browser type and browser version. We may collect certain mobile device information such as device ID, model number, operating system, global positioning data, application, and other related information.

 

2.5.    We advertise in several ways, including but not limited to through managed social media presences, and on other unaffiliated sites and mobile applications. To understand how our advertising campaigns are performing, we may collect certain information via our Platform through our advertising service providers. We or our vendors use several common online tracking tools to collect information about our Users, such as browser cookies, web beacons, and other similar technologies. The information we collect includes IP addresses, the number of page visits, pages viewed via our Website, search engine referrals, browsing activities over time and across other websites following your visit to one of our Website or applications, and responses to advertisements and promotions on the website and applications where we advertise. We do not permit third parties to advertise on our Website. We sometimes work with online advertising vendors to provide you with relevant and useful ads. This may include ads served on other companies’ website. These ads may be based on information collected by us or third parties. For example, your geographical location may be used to target an ad for people in your area. These ads may also be based on your activities on our Website or on third party website.

 

2.6.    We may combine information about you that we already have with information we obtain from other sources, to provide you a better end user experience or to improve the quality of our Services. Examples of information we may receive from other sources includes details of the Mandate Information available to us, customer support or enrolment information, page view, search term and search result information, and credit or identity information which we may use to detect fraud.

 

2.7.    Please note that we use google analytics and similar kind of tools for the purpose of analytics and measurement of the Services. For example, we may use the data gathered from your usage of the Services by Facebook, Twitter etc. to design new products or services, or to make our existing offerings under the Services more user friendly.

 

2.8.    Apart from the information listed above and the Personal Information made available to us while providing our Services, we do not collect any other sensitive information such as financial data, political views of any individuals, health-related information or sexual orientation of any individuals, information related to race, caste or language (Collectively, “Sensitive Personal Information”), unless required by the provisions of any applicable law.

 

2.9.          Other Communications: The User may also be required to provide Personal Information to the Provider when the User communicates with the Provider in any other way, including when you:

2.9.1.       request for further information on our Services;

2.9.2.request for any advice or assistance in relation to the Website Content, including any resource tools thereof; or

2.9.3.report a problem or contact us by way of email, telephone call, fax message, letter or through any other authorized means of communication.

 

3.       USE OF DATA

3.1.    Any Personal Information submitted to us, together with any other information, material, or content you have provided (collectively here in after referred to as, “Data “) shall be used primarily for administrative purposes and for the purposes to which they were submitted or required.

3.2.    We may also decide to use the Data for the following additional purposes:

3.2.1.to contact you and understand what your needs and requirements are;

3.2.2.by responding to your requests.

3.2.3.to provide personalized content and match the most relevant Services for you;

3.2.4.to improve on our marketing and customer service efforts;

3.2.5.to conduct our recruiting and selection process;

3.2.6.to enter into or carry out contracts of various kinds.

3.2.7.in other advertising, statistical compilation, or marketing-related purposes, and

3.2.8.to profile your information preferences, for example, understanding how you use the Platform, reviewing the nature of your communication and/or reviewing your search contents, any service pages or any Website Content you access.

3.2.9.to prevent and detect any fraud or other illegal activity on the Platform, and to prevent violations of our general T&C;

3.2.10.    to improve the security of the Platform;

3.2.11.    to provide you with technical service and support, including updates;

3.2.12.    to back up our systems to ensure preparedness for disaster recovery;

3.2.13.    To improve the quality, features and functionality of the Services, including measurement of service usage and efficiency of algorithms;

3.2.14.    For the purposes of auditing, research, and analysis to ensure the technical stability of the Platform;

3.2.15.    to comply with applicable laws, regulations, guidance, or professional obligations that we may be subject to;

3.3.    Unless you inform us otherwise in accordance with Clause 5.4, we may also use your Data to communicate with us (“Communications”):

3.3.1.responding to your requests.

3.3.2.by sending you notices regarding updates, changes or additions to our Services or Website Content or regarding any promotions which may be of interest to you.

3.3.3.by inviting you to participate in our surveys;

3.3.4.by requesting for your views on the Platform and/or our Services and/or customer support.

4.       DISSEMINATION OF DATA

4.1.    Be assured that we will never sell your Data to any third parties for commercial gain.

4.2.    However, we may disclose your Data:

4.2.1.to our consultants, advisors, service providers and agents (“Authorized Representatives”)

4.2.2.to assist us to achieve the purposes described in Clauses 3; and

4.2.3.to assist us in our Communications to you (unless you have informed us that you do not wish to receive any of our Communications in accordance with Clause 5.4); and

4.2.4.to our business partners who may communicate with you (“Business Partner Communications”)

4.2.5.by sending you notices regarding any promotions or products, or services offered by them which may be of interest to you;

4.2.6.to facilitate payment processes and verify payment information;

4.2.7.for other advertising, statistical compilation, or marketing-related purposes; or

4.2.8.by responding to your requests unless you have informed us that you do not wish to receive any Business Partner Communications in accordance with Clause 5.4.

4.3.    We may also be required to disclose your Data in the following circumstances:

4.3.1.to comply with a legal process;

4.3.2.to enforce the general T&C, this Privacy Policy or any other agreements executed with you or any related entity;

4.3.3.to protect the rights, property, or personal safety of other Users and/or the public, or to prevent fraud or illegal activity or to protect the business operations of the Platform;

4.3.4.where applicable, to credit reference agencies, where your Data may be used by other credit grantors for the purposes of:

4.3.5.making credit decisions about you and the people with whom you are financially associated with;

4.3.6.fraud or money laundering prevention; and

4.3.7.occasionally, for tracing debtors.

4.4.    If you post or send offensive or objectionable content to us or otherwise engage in any disruptive behavior in respect of the Platform, we can use whatever Data that is available to us about you to stop such behavior. This may involve informing relevant third parties such as your employer and law enforcement agencies about the content and your behavior. Accordingly, your Data will be disclosed where we are obliged or permitted by law to do so.

 

5.       CONSENT AND OPTING-OUT

5.1.    By submitting or providing your Data to us, you expressly acknowledge, consent, and agree to:

5.1.1.our use or processing, or the disclosure to, or use or processing by, Authorized Representatives, of your Data, including any Personal Information contained in your Data, for the purposes described in Clauses 3;

5.1.2.subject to Clause 5.4, the use or processing of your Data, including any Personal Information contained in your Data, for the purpose of sending you any Communications; and

5.1.3.subject to Clause 5.4, the use or processing by our Business Partners of your Data, including any Personal Information contained in your Data, for the purpose of sending you Business Partner Communications.

5.2.    We maintain reasonable and appropriate, albeit not infallible, physical, electronic, and procedural safeguards intended to maintain the confidentiality of Personal Information, including that provided by a visitor to this Platform and provided while availing our Services. We do not guarantee that our safeguards will always work.

5.3.    All Data is kept in a secure place with restricted physical or electronic access, and with confidentially preserved. Only the authorized management team of the Provider is permitted access to the Data on a “need-to-know” basis. Notwithstanding the aforesaid, you expressly acknowledge and agree:

5.3.1.that the transmission of information via the internet is not completely secure. We will do our best to protect your Data, but we are unable to guarantee the security of your Data submitted or provided through or in connection with our Platform, and accordingly, any submission or provision of Data is made at your own risk; and

5.3.2.that the transfer and processing of your Data may be undertaken in countries outside of India, which may not provide the same level of data protection as India. If we do make such a transfer or if your Data is to be processed outside India, we will put a contract in place to ensure your Data is protected.

5.4.    You may inform us by way of email sent to hello@multicounsel.com if you wish to exercise your right to opt out of receiving any Communications from us or Business Partner Communications from our business partners. If you do opt out, this may preclude you from receiving any of our special offers or promotion, whether offered by us or by any business partners in future.

6.       RETAINING AND DELETING DATA

6.1.    Upon termination of your access to the Platform in accordance with the general T&C, we may still be required to retain your Data in order to comply with legal obligations, prevent fraud, collect fees owed (if any), resolve disputes and troubleshoot problems etc., but always done within a legal framework.

6.2.    When you request for your Data to be removed in accordance with Clause 5.4, you will be added to a suppression list to ensure your request is complied with.

7.       INFORMATION REQUESTS

7.1.    You have a right to ask for a copy of your Personal Information and are obliged to correct any inaccuracies in your Personal Information. If you are unable to use our Platform to correct such inaccuracies, you may ask us to do so on your behalf (where possible).

7.2.    Unless the Personal Information relates to an individual which you are legally responsible for (such as a minor), you may not give us Personal Information about any other person. If you do so, you confirm that they have appointed you to act on behalf of them, to consent to the processing of their Personal Information, including sensitive personal data, to the transfer of their Personal Information abroad and to receive on their behalf any Communications from us or any Business Partner Communications from our business partners.

8.       COOKIES

8.1.    If you visit our Website, as with the majority of website on the internet, our computer server may automatically send you a cookie. A cookie is a small ‘log-file’ that can be placed on your computer’s hard disk for record-keeping purposes, and we may use them to do a number of things:

8.1.1.cookies help us to recognize you when you next visit our Website and note the advertisements displayed to you. This allows us to tailor the promotions we provide to your preferences. We may use the services of third-party servers for this purpose;

8.1.2.cookies may be used to compile anonymous statistics related to the take up or use of services, or to patterns of browsing. A third party may collect such data on our behalf to measure the performance of the Website. Information collected is aggregated for reporting purposes, and no personally identifiable information is collected by this service. The use of this service assists us in measuring and improving the structure and ease of use of the Website

8.1.3.we may also track IP addresses. An IP Address is a number that can identify an Internet Service Provider, country location etc. It cannot provide personal information. We will not use the IP Address to build a profile on Users; we only use the information for demographic and statistical purposes.

8.2.    It is also possible that others may download cookies to your computer when you access, visit, or use the Platform. We cannot control nor do we have access to any cookies placed on your computer by such other persons.

 

8.3.    Users have the ability to control cookies through your browser settings. How you do so, however, depends on your browser and the type of cookie. Certain browsers can be set to reject all browser cookies. If you configure your computer to block all cookies, you may disrupt certain web page features, and limit the functionality we can provide when you visit or use our Website. If you block or delete cookies, not all the tracking that we have described in this policy will stop. Some browsers have a “Do Not Track” feature that lets you tell website that you do not want to have your online activities tracked. These browser features are still not uniform, so we are not currently set up to respond to those signals.

8.4.    Cookies cannot be used by themselves to identify you. You are not obliged to accept cookies and may modify your browser so that it will not accept cookies. If you do disable cookies, many of the Services may not be available to you.

9.       MODIFICATION OF PRIVACY POLICY

9.1.    This Privacy Policy may be modified from time to time as a result of any changes in the law, best practice and/or on the Platform without notice to you. The most current version of this Privacy Policy as posted on this page shall supersede all previous versions.

9.2.    It is your responsibility to check regularly to determine whether a new version of the Privacy Policy has been uploaded.
